Real estate outcomes depend on market conditions, comparable sales activity, buyer demand, property condition, lender appraisals, and many other factors outside an agent's control. Past results from prior clients are not predictions or guarantees of future results for your specific property.
Comparative Market Analysis (CMA) Is Not an Appraisal: Any pricing recommendations, market analyses, or "what your home is worth" estimates I provide are based on comparable sales data and market conditions at the time of analysis. A CMA is not a formal appraisal and is not intended to be used for lending, tax, legal, or insurance purposes. For appraisal-grade valuations, hire a state-licensed Hawaiʻi appraiser.
Net Proceeds Estimates: Any seller net sheets, closing cost estimates, or "what you'll walk away with" projections are estimates based on standard assumptions and information you provide. Actual net proceeds will vary based on final sale price, negotiated repairs, closing date, lender requirements, payoff amounts, prorations, and other transaction-specific factors. Final figures are determined by your escrow officer at closing.
Hawaiʻi-Specific Tax Withholding: Sellers in Hawaiʻi may be subject to HARPTA (Hawaiʻi Real Property Tax Act — state withholding for non-resident sellers), FIRPTA (Foreign Investment in Real Property Tax Act — federal withholding for foreign sellers), and GE Tax (4.712% on Oʻahu real estate transactions). These are tax matters — I am a real estate professional, not a tax advisor. For HARPTA, FIRPTA, capital gains, or 1031 exchange questions, consult a qualified Hawaiʻi-experienced CPA or tax attorney before listing your property.
Marketing Performance: While I employ strategic marketing including professional photography, MLS listings, social media, broker networks, and digital advertising, marketing reach and engagement results vary by listing. I cannot guarantee specific impressions, showings, offers, or buyer response rates. Marketing strategies are tailored to each property and adjusted based on market response.
Required Disclosures Are Your Responsibility: Hawaiʻi law requires sellers to provide a Seller's Real Property Disclosure Statement (SRPDS) to buyers, plus federal lead-based paint disclosures for pre-1978 homes. While I assist with disclosure forms as part of my listing services, the accuracy and completeness of disclosures are the seller's legal responsibility. Withholding known material defects can result in legal action even after closing.
